Woman Agrees To Pay Back Her Neighbour In Out-Of-Court Settlement

The Situation:  Elderly Mrs Wilson appointed her neighbour, Mrs Crick, to act on her behalf under an enduring power of attorney.  Mrs Wilson paid Mrs Crick more than $300,000 by several cheques.  Mrs Wilson then engaged Quinn & Scattini to act on her behalf to sue Mrs Crick to recover the money she had paid to Mrs Crick.   Mrs Wilson subsequently lost her mental capacity, and the Supreme Court appointed her nephew, Paul, to represent her to continue the action against Mrs Crick.  Quinn & Scattini acted on a deferred-fee basis.

The Result:  A win for Quinn & Scattini’s client.  The case was settled out of court, with Mrs Crick agreeing to make a refund of money and to pay Mrs Wilson’s legal costs.  The Supreme Court approved the out-of-court settlement.
